In this third article on the role of international comparative practices in the formation of national health care systems I discuss a familiar group of systems-builders--medical professional organisations--and so focus on some early comparisons undertaken by organised groups of doctors. So far in this series I have argued that any attempt to make international comparisons--whether in the 19th-century or today--is bound to be based on a 'characteristically national' understanding. Not infrequently such an understanding finds its clearest expression in the very (...) act of undertaking practical tasks like 'comparing'. Dependent on whether comparisons are carried out by individuals privately, collectively by larger groups within the medical profession, or by government agencies the descriptions of 'national characteristics' (of medical organisation, institutional formation, clinical practice, research, public health and education) will differ in emphasis. -/- The examination of collective professional attempts at international comparison can enhance our understanding of the cultural distinctions that were incorporated by emerging national medical professions. This process can show which aspects of foreign medical systems were deemed pertinent, and also reveals methodology. What did such collective endeavours add to the more biographically coloured comparisons undertaken by the individual mid-century authors I discussed in part II of this series? (shrink)

The accounts of Wunderlich and Lee, which have been presented in the second part of this brief series, are two representative examples of a well-respected 19th-century genre of international comparison of medical systems. Since these early comparative accounts consist of observations on medical systems by doctor-travellers at a time when intense medical reform debates about the national significance of medicine were taking place, the focus of attention is often intra-professional. In texts such as those by Wunderlich and Lee, creating coherence (...) within a national health care system was primarily understood as constructing national coherence within the medical profession. The comparisons which derived from international travellers of the period were on the whole cast in a literary, narrative form, and were based on personal observation and occasional hands-on experience in foreign practice. The relevance of this type of publication for national policy at this early stage of national system development was defined in terms of the perceived advantages which a more detailed explication of differences between the medical educational structures, medical philosophies and practical professional roles in different nations might bring. This study presents a first assessment of the challenges faced by Dutch health care providers dealing with the increasing cultural diversity in Dutch society. Qualitative interviews with 24 Dutch caregivers and policy-makers point to a number of important difficulties encountered when confronted with the growing diversity of patient populations. The study focuses explicitly on the challenges health care providers perceive in their direct interactions with patients. On the basis of the observations of the 24 respondents five strategies were formulated to (...) improve the delivery of care in a multicultural environment. Their findings were further evaluated by confronting the empirical data with care-ethical notions (attentiveness, responsibility, competence, and responsiveness) and intercultural communication-theory. Due to their frequent uneven cognitive profiles, genetic developmental disorders allow researchers to investigate which numerical sub-system of those present in typically developing infants best predicts subsequent numerical abilities. More importantly, they can provide evidence of which other cognitive abilities outside number are necessary for the successful development of these numerical sub-systems. We discuss evidence from cross-syndrome comparisons of adults, adolescents, children, and infants with Williams syndrome and those with Down syndrome to show that the approximate magnitude sub-system is crucial (...) for later number development. In addition, we show that specific problems outside the number domain, and within basic-level visual and attention systems contribute to an explanation of the difficulties and proficiencies observed within each genetic disorder. Finally, we argue that a truly developmental approach is critical when using the cross-syndrome design in order to reveal subtle differences that impact over time on the development of cognitive abilities. The target article by Locke & Bogin (L&B) focuses on the evolution of language as a communicative tool. They neglect, however, that from infancy onwards humans have the ability to go beyond successful behaviour and to reflect upon language (and other domains of knowledge) as a problem space in its own right. This ability is not found in other species and may well be what makes humans unique.

After 150 years of scientific developments, the periodic system of chemical elements is still an icon of modern science. Its resilience is striking. The icon used today by scientists and teachers is in fact the outcome of many rearrangements and reinterpretations by the scientific community during that period. This success is often explained as a result of the underlying atomic structure, discovered in the first decades of the 20th century, an explanation that completely neglects the fine structure of the process (...) of ongoing renegotiation and successive stabilizations. How did indeed contemporary scientists navigate in times of reinterpretation? The physicist Lise Meitner and the chemist Ida Noddack were, in different ways, involved in discoveries and interpretations of the periodic system. In 1934, as part of the celebration of the centenary of Dmitri Mendeleev's birth, they each published an article on the system: Meitner in Die Naturwissenschaften, and Noddack in Angewandte Chemie. These two articles, written from the perspectives of a nuclear physicist and a chemist experienced in searching for undiscovered elements, respectively, constitute excellent sources for understanding what new discoveries and insights meant for the meaning and value of the periodic system at the very beginning of the nuclear age in science. Through an analysis of the two contributions, we will argue that resilience is the foremost value of the periodic system. We will also discuss what this value means for the future of the periodic system and its representations. (shrink)

I take up Eve Sedgwick’s invitation to begin with stigma “as a near-inexhaustible source of transformational energy” for a transformative queer politics and elaborate Sedgwick’s attention to spoiled identity through Hortense Spiller’s conceptualization of the flesh. The flesh substantiates the grounds for a materialist ontology that begins with stigma, the materiality (...) of the wound, to constitute a transformative politics toward a fugitive elsewhere. Reading Sedgwick and Spillers together opens up a transformative ontological register that spans the material, affective, and fugitive. I argue that the hieroglyphics of the flesh give us knowledge of ourselves and others and the world we have lived through but also invite us to transform who and what we are, how we relate, and what a world might look like where our being is not constituted by fugitive survival. I suggest that such hieroglyphics can be engaged by touching wounds understood as a haptic reading of textures impressed on our embodied being while paying attention to the lines of flight that erupt from the wound. This article explores the arguments for and against victims’ mitigating opinions on sentence. It describes a recent South African appeal case, compares it with a similar New Zealand appeal court judgment, and then investigates the legal position in England and Wales. It appears that, as a general rule, victims’ recommendations as to penalty must be avoided. However, unlike in South Africa and New Zealand, the jurisprudence in England and Wales has developed exceptions in this regard when certain categories of victims (...) request a more lenient sentence. Several cases from England and Wales reveal that, through considering the harms and needs of victims and ameliorating the sentences accordingly, a restorative justice approach is blended with a just deserts requirement for the protection of lower limits in sentencing. This ensures that the principles of proportionality, certainty and consistency are still adhered to. It is concluded that, had the South African court properly considered these comparative legal developments, it would, at the very least, have created a better precedent by providing guidelines to inform the complex, but important, process of considering victims mitigating opinions in the sentencing process. In this article we investigate the way in which viral load assays are used to assess the viruses of Human Immunodeficiency Virus (HIV)-positive pregnant women who are cared for in an HIV-specialist antenatal clinic in London. One of the viral load assays has been made more sensitive to subtypes of the virus that are considered to be local, possibly reading the viruses of those who have ‘foreign’ subtypes as undetectable. Consequently, the patient might not be offered the kind of care (...) needed to prevent transmission of HIV, as her body is not recognised as sufficiently debilitated. Thus, being identified as a debilitated body in this setting facilitates the prevention of vertical transmission of HIV and the management of the HIV-positive pregnant patient's virus. Further to this, we argue that in our example, having a debilitated body as constructed by the viral load assay is thus a ‘privilege’ that is accorded to HIV-positive persons depending on the geographic origin of their virus. Using Karen Barad's agential realism, we argue that the manner in which HIV is read through the viral load assay constructs a specific woman/foetus/hiv phenomenon. The specificity of this phenomenon directly impacts on the course of care, opening up or foreclosing the possibility of her child having a future free from HIV. (shrink)

Queen pheromones, which signal the presence of a fertile queen and induce daughter workers to remain sterile, are considered to play a key role in regulating the reproductive division of labor of insect societies. Although queen pheromones were long thought to be highly taxon‐specific, recent studies have shown that structurally related long‐chain hydrocarbons act as conserved queen signals across several independently evolved lineages of social insects. These results imply that social insect queen pheromones are very ancient and likely derived from (...) an ancestral signalling system that was already present in their common solitary ancestors. Based on these new insights, we here review the literature and speculate on what signal precursors social insect queen pheromones may have evolved from. Furthermore, we provide compelling evidence that these pheromones should best be seen as honest signals of fertility as opposed to suppressive agents that chemically sterilize the workers against their own best interests. The study of alternative genetic systems and mixed modes of reproduction, whereby sexual and asexual reproduction is combined within the same lifecycle, is of fundamental importance as they may shed light on classical evolutionary issues, such as the paradox of sex. Recently, several such cases were discovered in social insects. A closer examination of these systems has revealed many amazing facts, including the mixed use of asexual and sexual reproduction for the production of new queens and workers, males that can (...) clone themselves and the routine use of incest without deleterious genetic consequences. In addition, in several species, remarkable cases of asexually reproducing socially parasitic worker lineages have been discovered. The study of these unusual systems promises to provide insight into many basic evolutionary questions, including the maintenance of sex, the expression of sexual conflict and kin conflict and the evolution of cheating in asexual lineages. Background Outbreaks of infectious disease cause serious and costly health and social problems. Two new technologies – pathogen whole genome sequencing and Big Data analytics – promise to improve our capacity to detect and control outbreaks earlier, saving lives and resources. However, routinely using these technologies to capture more detailed and specific personal information could be perceived as intrusive and a threat to privacy. Method Four community juries were convened in two demographically different Sydney municipalities and two regional cities in (...) New South Wales, Australia to elicit the views of well-informed community members on the acceptability and legitimacy of: making pathogen WGS and linked administrative data available for public health researchusing this information in concert with data linkage and machine learning to enhance communicable disease surveillance systems Fifty participants of diverse backgrounds, mixed genders and ages were recruited by random-digit-dialling and topic-blinded social-media advertising. Each jury was presented with balanced factual evidence supporting different expert perspectives on the potential benefits and costs of technologically enhanced public health research and communicable disease surveillance and given the opportunity to question experts. Results Almost all jurors supported data linkage and WGS on routinely collected patient isolates for the purposes of public health research, provided standard de-identification practices were applied. However, allowing this information to be operationalised as a syndromic surveillance system was highly contentious with three juries voting in favour, and one against by narrow margins. For those in favour, support depended on several conditions related to system oversight and security being met. Those against were concerned about loss of privacy and did not trust Australian governments to run secure and effective systems. Conclusions Participants across all four events strongly supported the introduction of data linkage and pathogenomics to public health research under current research governance structures. Combining pathogen WGS with event-based data surveillance systems, however, is likely to be controversial because of a lack of public trust, even when the potential public health benefits are clear. Any suggestion of private sector involvement or commercialisation of WGS or surveillance data was unanimously rejected. (shrink)

Immunological mechanisms and therapy approaches in psychotic syndromes were recently supported by the discovery of autoantibody-associated limbic and non-limbic encephalitis. However, how clinical diagnostic procedures in psychiatry should be adapted to these new insights is still unclear. In this study, we analyzed the cerebrospinal fluid (CSF) and neuroimmunological alterations and their association with cerebral MRI (cMRI) and electroencephalographic (EEG) findings. From 2006 until 2013, we acquired 180 CSF samples from psychotic patients. Between 2006 and 2009, CSF examinations were only performed (...) in cases in which organic brain disease was suspected. Since then, this procedure has been integrated into our routine diagnostic workup. CSF basic diagnostics were supplemented by measuring antineuronal antibodies against intracellular synaptic antigens, antibodies against intracellular onconeural antigens, antibodies against neuronal cell surface antigens and thyroid antibodies. In addition, cMRIs and EEGs were conducted. We found white cell counts elevated in 3.4% of the cases, albumin quotient elevated in 21.8%, and protein concentration elevated in 42.2%. Evidence of intrathecal immunoglobulin synthesis was found in 7.2% of the cases. Antibodies measured against neuronal cell surface antigens were positive in 3.2%. Reactivity on antibodies against intracellular onconeural antigens were detected in 3.5%. Serum thyroid antibodies were elevated in 24.7%. Abnormalities were found in 39.5% of cMRIs and in 34.3% of EEGs. The main finding of our study was the high prevalence of CSF and autoantibody abnormalities in 54.4% of psychotic patients. In combination with cMRIs and EEGs, 75.6% showed abnormal findings. Our results are discussed with regard to the concept of immunological encephalopathy. Future studies should analyze the efficacy of immunomodulatory therapies. (shrink)

Today, many visual artists are giving the cold shoulder to the static, isolated concept of visual art and searching instead for novel, dynamic connections to different image strategies. Because of that, visual art and aesthetics are both forced to reconsider their current positions and their traditional apparatus of concepts. In that process, many questions surface. To mention a few: Could the characteristics of an artistic image and its specific manner of signification be determined in a world which is entirely aesthetisized? (...) What would be the consequences of a variety of image strategies for aesthetic experience? Would it be possible to develop a form of cultural criticism by means of artistic activities in a culture awash in images? In order to answer such questions, aesthetics as a philosophy of art needs to transform its field into a critical philosophy of topical visual culture. As an impetus to such a reinterpretation of the visual working area, the L & B Series organized three symposia evenings under the title “Exploding Aesthetics”, in cooperation with De Appel Center for Contemporary Art, Amsterdam. The fact that this series ended up being framed by the turbulent temporality of the current pandemic is something that some future editors of (...) philoSOPHIA, too, might find worth remembering.For now, we return to the now-point, as expected. To that end, here we have assembled articles on historical, individual, and gendered stigmas and wounds and traumas, among others, focusing also on their relationships to existential time, namely, present moments that persist.We turn first to the pressing issue presented by “Shackling Pregnant Women: US Prisons, Anti-Blackness, and the Unfinished Project of American Abolition”: Brady Heiner offers a lucid “interpretation of the social meaning of shackling imprisoned pregnant women and its persistence despite widespread normative consensus in favor of its abolition,” a joltingly specific, haunting reminder of how deeply the legacy of slavery is embedded in the US criminal legal system and the ways in which American abolition remains an “unfinished project.”Finally, RETRO III marks an ending and a restart of another kind. As of this issue—or, rather, this volume—philoSOPHIA is transitioning from a biannual to an annual publication schedule. In recent years, the journal has transformed in various ways. In 2018, we adopted a new transContinental approach and, with it, a new subtitle. We have expanded to include different [End Page v] genres, media, and voices, always aiming to reflect on our current moment and rethink persistent feminist philosophical questions from divergent angles. Publishing one volume per year is, we are certain, the best way to sustain this breadth of inquiry and continue deepening our alliances with critical race, disability, literary, media, and queer studies, among other fields. As we restart, readers can expect us to keep pushing boundaries, as we always have, while maintaining the same high quality and standards. This is essentially a change in the journal’s format, not in its substance.Wound/stigma as process also emerged as a key notion in Retro III partly because of our preliminary editorial conversation with Annette-Carina van der Zaag about three years ago, who, in response to our call for proposals on “retro” themes, had proposed an idea of guest editing an issue. Although that plan unfortunately did not materialize as we dealt with various pandemic challenges still faced by so many of us on a daily basis, Annette did write a spirited article while encouraging some other colleagues to explore related ideas, for which we remain grateful. In this piece, “Touching Wounds: On the Fugitivity of Stigma,” which explores stigma’s queer-responsive “transformational energy,” van der Zaag articulates ways of “inhabiting” wounds on three registers—material, affective, and fugitive—as an open-ended, future-embracing pathway beyond identity-bound ontology. Ghalya Saadawi, in turn, in her engagingly autobiographical essay “Critical Incision: Hypochondria, Autotheory, and the Health-Illness Dialectic,” autotheoretically draws out “critical” energy from this critical “illness” of hers, hypochondria, to the effect of destabilizing the temporally linearized and medically coordinated discursive ideals of health and being/living well.Survival, at the end of the day, often requires some literal transcending. A case in point has been movingly portrayed and theorized by Na-Young Lee, a sociologist and justice activist who, in “Multiple Encounters and Reconstructed Identities,” revisits questions of historical trauma and collective stigma. Here, she introduces and reflects on her oral history interviews with Korean “Halmoni Activist-Survivors of Japanese Military Sexual Slavery as Postcolonial Subjects,” with whom she herself continues to fight in solidarity. Focusing on the stories of two foundational figures, “Yun Chung-ok, a leading scholar and activist who, having managed to escape the fate of many other peers, first spoke out about Japanese military sexual slavery, and Kim Bok-dong, a survivor and human rights activist,” Lee shows how “overcoming trauma and reaching out to others continues to drive the redress movement” and how “through mutually constructed identities, activist-survivors broke away from... Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza. Next SectionWhilst there has been considerable debate about the fit between moral theory and moral reasoning in everyday life, the way in which moral problems are defined has rarely been questioned. This paper presents a qualitative analysis of interviews conducted with 15 general practitioners (GPs) in South Australia to argue that the way in which the bioethics literature defines an ethical dilemma captures only some of the range of lay views about the nature of ethical problems. The bioethics literature has (...) defined ethical dilemmas in terms of conflict and choice between values, beliefs and options for action. While some of the views of some of the GPs in this study about the nature of their ethical dilemmas certainly accorded with this definition, other explanations of the ethical nature of their problems revolved around the publicity associated with the issues they were discussing, concern about their relationships with patients, and anxiety about threats to their integrity and reputation. The variety of views about what makes a problem a moral problem indicates that the moral domain is perhaps wider and richer than mainstream bioethics would generally allow. (shrink)

Between 2013 and 2016, West Africa experienced the largest ever outbreak of Ebola Virus Disease. In the absence of registered treatments or vaccines to control this lethal disease, the World Health Organization coordinated and supported research to expedite identification of interventions that could control the outbreak and improve future control efforts. Consequently, the World Health Organization Research Ethics Review Committee was heavily involved in reviews and ethics discussions. It reviewed 24 new and 22 amended protocols for research studies including interventional (...) and observational studies. WHO-ERC provided the reviews within on average 6 working days. The WHO-ERC often could not provide immediate approval of protocols for reasons which were not Ebola Virus Disease specific but related to protocol inconsistencies, missing information and complex informed consents. WHO-ERC considerations on Ebola Virus Disease specific issues are presented. To accelerate study approval in future public health emergencies, we recommend: internally consistent and complete submissions with information documents in language participants are likely to understand, close collaboration between local and international researchers from research inception, generation of template agreements for data and sample sharing and use during the ongoing global consultations on bio-banks, formation of Joint Scientific Advisory and Data Safety Review Committees for all studies linked to a particular intervention or group of interventions, formation of a Joint Ethics Review Committee with representatives of the Ethics Committees of all institutions and countries involved to strengthen reviews through the different perspectives provided without the ‘opportunity costs’ for time to final approval of multiple, independent reviews, direct information exchange between the chairs of advisory, safety review and ethics committees, more Ethics Committee support for investigators than is standard and a global consultation on criteria for inclusion of pregnant women and children in interventional studies for conditions which put them at particularly high risk of mortality or other irreversible adverse outcomes under standard-of-care. As artefacts, the worlds of digital games are designed and developed to fulfil certain expressive, functional, and experiential objectives. During play, players infer these purposes and aspirations from various aspects of their engagement with the gameworld. Influenced by their sociocultural backgrounds, sensitivities, gameplay preferences, and familiarity with game conventions, players construct a subjective interpretation of the intentions with which they believe the digital game in question was created. By analogy with the narratological notion of the implied author, we call the (...) figure to which players ascribe these intentions ‘the implied designer’. In this article, we introduce the notion of the implied designer and present an initial account of how appreciators ascribe meaning to interactive, fictional gameworlds and act within them based on what they perceive to be the designer’s intentions. Dynamic epistemic logic describes the possible information-changing actions available to individual agents, and their knowledge pre-and post conditions. For example, public announcement logic describes actions in the form of public, truthful announcements. However, little research so far has considered describing and analysing rational choice between such actions, i.e., predicting what rational self-interested agents actually will or should do. Since the outcome of information exchange ultimately depends on the actions chosen by all the agents in the system, and assuming that agents (...) have preferences over such outcomes, this is a game theoretic scenario. This is, in our opinion, an interesting general research direction, combining logic and game theory in the study of rational information exchange. In this article we take some first steps in this direction: we consider the case where available actions are public announcements, and where each agent has a (typically epistemic) goal formula that she would like to become true. What will each agent announce? The truth of the goal formula also depends on the announcements made by other agents. We analyse such public announcement games. (shrink)
